FilmOn and its owner, Alki David, has had an up-and-down time in court. The latest instance of David’s court saga includes CBS wanting a court order filed against David’s online subscription network.

According to Deadline, CBS asked a U.S. District Court in New York to enter an order to make sure David pays his $1.6 million copyright infringement settlement. The order also concerns David getting rid of some material that’s against CBS. CBS is invoking Section 5.3 of their agreement, which includes that David shut down “inflammatory anti-CBS material” like cbsyousuck.com. However, as you can see from the link, cbsyousuck.com is still up and running.

David says he has no obligation to take down the material he posted before the 2012 agreement because it would be infringing on his First Amendment rights. But CBS’s lawyers state taking down the material is part of the agreement, imposes no burden and doesn’t infringe upon David’s rights. CBS’s lawyers also argue that he could shut down the material at any time. There are also charges that David has violated the 2012 settlement because he hasn’t given any evidence showing he is no longer providing funds to the lawsuit against CBS’s interactive company, CNET, even though that was part of the agreement.
